Court clarified oath issue: SJ

The High Court judgment on the oath-taking of legislators-elect Sixtus Leung and Yau Wai-ching has set clear guidelines for the Government and Legislative Council to follow when dealing with oath-taking matters.

 

Secretary for Justice Rimsky Yuen made the statement today, saying the court ruling has elaborated on the principle and related matters of oath-taking by legislators that is required by Basic Law Article 104.

 

Mr Yuen noted the judge, in his ruling, accepted the Government’s legal viewpoints, including its written submissions after the National People’s Congress Standing Committee’s Basic Law interpretation.

 

The ruling stays, with or without the Basic Law interpretation.

 

Mr Yuen said he understands the interpretation means to explain the general principle of Article 104, rather than targeting an individual case.

 

The Government must study the court ruling before deciding the way forward, he said, adding it will handle the matter as soon as possible.
