Police to get advice on assisting bailiffs

November 11, 2014

The Department of Justice will provide legal advice to Police on assisting bailiffs to execute the High Court's injunction orders to remove obstructions in Mong Kok and outside CITIC Tower, Secretary for Justice Rimsky Yuen says, adding that it is not a clearance action.

Mr Yuen stressed that yesterday’s judgment had made clear that the protesters’ occupation is illegal, urging them to respect the rule of law and not to breach the injunction orders.

If protesters re-occupy the concerned area, bailiffs can enforce the injunction orders as long as they are still effective, he explained, adding that protesters’ appeals would not constitute a suspension of the injunctions.

Noting that such injunction orders are rare in Hong Kong, Mr Yuen said the department would examine completely what roles Police should play in carrying out the orders.
