Property authority clarifies buyers’ right

July 17, 2014

The Sales of First-hand Residential Properties Authority urges prospective purchasers to view the residential properties or comparable residential properties before signing the preliminary agreement for sale and purchase.

The authority found that the vendor of a new residential property, Mont Vert Phase I, asks buyers to sign a ‘no viewing agreement’ to be eligible for the balloting.

The Residential Properties (First-hand Sales) Ordinance stipulates that the vendor must make a residential property available for buyers' viewing before selling it to them.

The authority considers the Mont Vert arrangement a serious departure from the spirit of the ordinance which has seriously harmed the purchasers’ interest. It has written to the vendor for an explanation.

It reminds prospective Mont Vert Phase I purchasers not to give up their right to view the properties.
