Arrangements for a Legislative Council by-election have not been set as legal procedures are ongoing.
Secretary for Constitutional & Mainland Affairs Patrick Nip made the statement today in response to the recent court ruling that oaths taken by Lau Siu-lai, Yiu Chung-yim, Nathan Law and Leung Kwok-hung were invalid.
He said, in general, the Clerk to LegCo will announce the existence of a LegCo membership vacancy in the Gazette within three weeks.
The Electoral Affairs Commission then acts in accordance with the law and the actual situation to arrange a by-election.
Mr Nip said the by-election arrangement will be subject to the result of legal proceedings.
"Because the judicial proceedings are still ongoing in respect of the (Sixtus Leung - Yau Wai-ching) case, we are not in a position to arrive at a conclusion as to the by-election arrangements.
"As regards to the court judgment handed down last Friday in respect of the four persons, we are examining the judgment and we are not yet clear whether there would be further appeals, and how long the judicial proceedings will be."
The Government will monitor the situation and act in accordance with the law, Mr Nip added.
