LegCo prison views sought

The Government today published the Consultation Paper on Disqualification of Candidates with Unserved Prison Sentences to garner public views on the matter.

 

The Court of First Instance in 2012 found the Legislative Council Ordinance was inconsistent with the Basic Law and the Bill of Rights.

 

The Government then undertook to review the qualification of people with unserved prison sentences as candidates for Legislative Council elections, to consult the public on the matter, and propose any necessary changes to the electoral legislation.

 

The Government proposes to allow an appellant who is released on bail pending appeal to be nominated as a candidate in a LegCo election and be elected as a LegCo member until disposal of the appeal. But an escaped convict should be disqualified from nomination.

 

The Consultation Paper is available on the Constitutional & Mainland Affairs Bureau website.

 

Views can be sent by mail by September 30.
