An amendment bill to provide a workable method of calculating statutory entitlements for people under contract who earn commission will be submitted to the Legislative Council on December 20.
The Labour Department said the gazetted Employment (Amendment) Bill 2006 covers the following statutory entitlements: holiday pay, annual leave pay, maternity leave pay, sickness allowance, wages in lieu of notice for termination and end-of-year payment.
The bill aims to fully reflect the Government's original policy intention, that wages that include commission - no matter how it is designated or calculated - should be used as the basis for calculating these statutory entitlements.
