Contractor suspended from bidding

May 10, 2024

The Development Bureau has suspended the contractor and subcontractor involved in a fatal industrial incident at a construction site in Kai Tak from tendering for public works contracts.

The bureau noted that the contractor concerned was on the List of Approved Contractors for Public Works while the subcontractor concerned was under the List of Approved Suppliers of Materials & Specialist Contractors for Public Works.

Apart from notifying the contractor and subcontractor today that they are suspended from tendering for relevant categories of public works contracts, the bureau explained that they required to undergo an independent safety audit to review their safety management system.

They are also required to take heed of the audit’s findings and submit an improvement action plan and improvement measures, with a view to demonstrating that they have an effective safety management system in place, before removal of the suspension can be considered.

The suspension applies not only to future tender exercises, but also those in which procedures have been initiated but not concluded.

A government department is investigating the industrial incident, which happened on May 8, and will handle it in accordance with the law.

Based on the investigation’s findings, the bureau will impose further regulatory actions on the contractor and subcontractor concerned.
