Making non-payment of Labour Tribunal and Minor Employment Claims Adjudication Board awards a criminal offence is a significant policy breakthrough in protecting employees' rights,Secretary for Labour & Welfare Matthew Cheung says.

The amendment bill of the Employment Ordinance was passed in the Legislative Council Wednesday. Employers who fail to pay salaries face three years' jail and a $350,000 fine.

Speaking on a radio talk show today, Mr Cheung said the bill will save employees from entering lengthy civil procedures to claim unpaid salaries.

He said the bill will deter irresponsible employers who fail to comply with civil judgments of the Labour Tribunal or the Minor Employment Claims Adjudication Board.

Mr Cheung said the Government hopes to have the minimum wage legislation passed soon. He also said the Government does not recommend a mandatory annual review of wages, in order to allow flexibility for any adjustment.
