Privacy law review urged

Office of the Privacy Commissioner for Personal Data

A clearer interpretation and application of the Personal Data (Privacy) Ordinance will enhance the overall effectiveness in personal data privacy protection, Privacy Commissioner Roderick Woo says.

Releasing an investigation report on the alleged disclosure by Yahoo!Hong Kong of its account subscriber's personal data, Mr Woo said an investigation found the local email service provider had not contravened the Personal Data (Privacy) Ordinance. But the case gives rise to concern about the ordinance's scope of application.

"A clearer interpretation and application of the ordinance will enhance the overall effectiveness in the protection of personal data privacy. To this end, my office is proposing a legislative review of the ordinance and hope that the Government will facilitate the legislation amendment process," Mr Woo added.

He said issues arising from the investigation will be passed to the Home Affairs Bureau for consideration. To read the report, click here.
