Secretary for Justice Rimsky Yuen says the Judiciary is not part of the administration, adding that he did not sway from a statement he released as the Bar Association’s Chairman in 2008.
That statement said "the judiciary … is not, and should not be regarded as, part of the governance team".
Speaking to reporters today, Mr Yuen said governments are constituted of the administration, the legislature and the judiciary, and the concept of “separation of powers” means these three branches exercise their duties independently.
Mr Yuen stressed that the Department of Justice has always respected the Judiciary's independence, and considered safeguarding judicial independence as its top priority.
