Building management law review launched

The Home Affairs Department today launched a public consultation to review the Building Management Ordinance to cope with the changing needs and circumstances of building management.

 

Speaking at a press conference, Permanent Secretary for Home Affairs Betty Fung said the consultation outlined proposals to resolve people's concerns on building management, including disputes arising from large-scale maintenance projects, use of proxies at owners' corporation meetings, appointment and remuneration of deed of mutual covenant managers.

 

When discussing large-scale maintenance projects, the document proposed to raise the owners’ corporation meeting’s quorum from 10% to, say 20%, of the total number of owners, or raising the required shares of votes to pass a resolution from 50% to, say 75%, to ensure that there has been thorough discussion and wide participation by owners.

 

The document also proposed a package of legislative and administrative measures to improve the proxy arrangements for owners’ corporation meetings, providing more transparency to the proxy collection process.

 

It is also proposed to lower the owners’ corporation threshold from 30% to 20% of shares in aggregate, to assist large housing estates where a large number of owners are involved or where the developer holds a large share of ownership.

 

The document also outlined proposals to make it easier to terminate poorly performing deed of mutual covenant managers, and introduces measures to reduce their remuneration.
