Basic Law protects freedoms

The freedoms of speech, demonstration and assembly have been protected by the Basic Law since the establishment of the Hong Kong Special Administrative Region.

 

The Government made the statement after a public procession was staged today in support of the three activists jailed earlier this week for storming "Civic Square" in 2014.

 

The Government said the rule of law and judicial independence are important elements for the success of the "one country, two systems" principle.

 

It also said, as pointed out by the Department of Justice earlier, the decisions to prosecute the three activists and appeal their previous sentences were made in accordance with the Prosecution Code, the law and evidence, adding no political consideration was involved in their cases.

 

Allegations the court was under political interference are unfounded, the Government said, noting the joint statements of the Bar Association and the Law Society have highlighted the errors in these allegations.

 

"The court's acceptance of the Department of Justice's application to review the sentence indicated the application is well founded on legal grounds," the statement said.

 

"The whole process, from the decision to prosecute, conviction, the department's application for sentence review and the judgment of the Court of Appeal, has proceeded in accordance with Hong Kong's effective legal system."

 

Noting the defendants may lodge appeals against their latest sentences, the Government said their cases will be handled in accordance with judicial procedures.
