LegCo election open, fair, honest

The Electoral Affairs Commission, Registration & Electoral Office, Returning Officers and all officers responsible for electoral affairs have been handling matters relating to the Legislative Council Election in strict accordance with the Basic Law, legislation, and the principle of impartiality to ensure the poll is held in an open, fair and honest manner.

 

The Government made the statement in response to today's Civil Human Rights Front procession.

 

It said Returning Officers strictly follow the law in deciding whether nominations are valid.

 

Taking into account the required information, the Returning Officers of various geographical constituencies and functional constituencies have made decisions on the validity of each nomination according to the law and legal advice.

 

Where a nomination has been declared invalid, the Returning Officer recorded the decision and the reasons for making it in the nomination form for public inspection.

 

The commission said Hong Kong has a solid legal system and the existing electoral laws already provide for a mechanism to deal with disputes which might arise during an election.

 

Anyone holding different views on the arrangements or decisions should abide by the spirit of the rule of law and follow established legal procedures in handling such differences.

 

Any personal attacks against Returning Officers or actions which may involve criminal offences are unacceptable, it added.
