The decision that Edward Leung’s nomination to run for the upcoming Legislative Council election is invalid has legal grounds and the Returning Officer has clearly explained to him the reasons for the decision, Secretary for Justice Rimsky Yuen says.
Speaking to reporters today, Mr Yuen said when deciding upon the validity of a nomination, Returning Officers have to consider one’s allegiance to the Basic Law, adding that any advocacy for Hong Kong to be independent is incompatible with it.
He also said, unlike the upcoming poll, Edward Leung did not make an explicit “independence” claim when he ran for the LegCo by-election held earlier this year.
