Police given legal advice: SJ

The Department of Justice has given legal advice to Police on the alleged assault of a protester by seven police officers during the Occupy campaign last year.

 

Secretary for Justice Rimsky Yuen told reporters today the advice was given last week after consulting a top British lawyer on whether to prosecute the officers.

 

He said he cannot divulge the recommendations yet, adding it is unfair to say action has been slow as Police have had many cases to handle due to the Occupy campaign.

 

He said no political consideration has been taken into account in making the recommendation, saying the department makes all decisions by applying the standard stated in the Prosecution Code.

 

"In some cases we sought advice from independent Senior Counsel in Hong Kong. Sometimes we sought advice from Queen's Counsel in other jurisdictions such as England. The purpose of seeking independent advice from outside counsel is to ensure the independence of the decision."
