The Department of Justice has yet to decide whether to lodge an appeal after its application for a time extension to file a notice to fix the hearing date of a contempt of court case concerning Occupy activists was rejected.
Secretary for Justice Rimsky Yuen made the statement to reporters today after the contempt of court case brought against 17 Occupy activists was dropped.
Asked if there was an oversight by the department that resulted in the verdict, he said it has yet to decide whether to appeal, adding that if decides to and if the Court of Appeal agrees with it, there would be no question of oversight.
He said as the department still needs time to consider whether to appeal, it is too early to consider the question of an oversight.
